TAQVO · END USER LICENSE AGREEMENT
Terms of Service
Taqvo is a fitness tracker, not a safety service and not a medical device. It depends on your phone, its battery, and a mobile signal — so never rely on it as your only way to get help.
This agreement is between you and the developer of Taqvo. It is not an agreement with Apple.
1. This agreement
These terms are a binding agreement between you and the developer of Taqvo, an independent developer based in the Philippines ("the developer", "we"), covering the Taqvo iPhone app and the taqvo.app website (together, "Taqvo"). By downloading or using Taqvo you accept them. If you do not accept them, do not use Taqvo.
You acknowledge that this agreement is between you and the developer only, and not with Apple. The developer, not Apple, is solely responsible for Taqvo and its content.
How we handle your data is described in our Privacy Policy, which forms part of this agreement.
2. Scope of your license
We grant you a personal, non-transferable, non-exclusive license to use Taqvo on any Apple-branded product that you own or control, as permitted by the Usage Rules in the App Store Terms of Service. You may not distribute the app over a network where it could be used by several devices at once. You may not rent, lease, lend, sell, redistribute, or sublicense it.
You may not copy, decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of Taqvo, except to the extent the law expressly permits it despite this restriction.
The license lasts until it ends. It ends automatically if you break any of these terms, and it ends if you delete Taqvo. We may also suspend or end your access if you seriously or repeatedly misuse the service. On termination you must stop using Taqvo and delete all copies.
3. Use Taqvo safely
This is the part that matters most.
- Taqvo is not an emergency or safety service. Beacon lets someone you choose watch a workout in progress. It does not call for help, does not alert the authorities, and nobody at Taqvo monitors it. In an emergency, contact your local emergency number.
- It depends on things we do not control — your phone's battery, GPS reception, mobile data, Apple's services, and your recipient actually looking at the link. Any of these can fail. Never treat Taqvo as your only safety measure.
- It is not a medical device. Distance, pace, calories, heart rate, and readiness figures are estimates, not diagnoses. Do not use them to diagnose or treat any condition. Talk to a qualified professional before starting or changing how you train.
- Stay aware of your surroundings. Do not use Taqvo in a way that distracts you from traffic, terrain, or conditions. You are responsible for your own safety and for obeying local law.
4. Your account
You can track workouts as a guest. If you create an account, keep your credentials secure — you are responsible for activity under your account. Tell us promptly at support@taqvo.app if you think someone else has access.
You must be at least 13 years old, or the minimum age of digital consent where you live if that is higher, to create an account.
You can delete your account at any time from inside the app, in Settings. Deleting it removes your profile, workouts, Beacon history, social activity, settings, and stored photos.
5. Acceptable use
When using Taqvo, do not:
- Share a Beacon link that tracks someone without their knowledge and agreement, or use Taqvo to follow, harass, or intimidate anyone.
- Post content that is unlawful, hateful, harassing, deceptive, or infringes someone else's rights.
- Impersonate another person, or misrepresent your connection to anyone.
- Break, probe, or overload the service, or try to reach data that is not yours.
- Scrape, bulk-download, or resell data from the service.
- Use Taqvo for anything unlawful, or in breach of export or sanctions rules.
You can report content or behaviour in the app, or by emailing support@taqvo.app. We may remove content or restrict accounts that break these rules.
6. Your content
Your workouts, photos, notes, and posts remain yours. You give us only the permission we need to run the service — to store your content, and to display it to the people you have chosen to share it with, according to your privacy settings. This permission ends when you delete the content or your account, except for copies kept briefly in backups.
You are responsible for what you post, and you confirm you have the right to post it.
7. Price, subscriptions, and changes to the service
Core workout tracking is free. Taqvo Pro is available as a monthly or yearly auto-renewing subscription through the iOS App Store, with a one-month free trial for eligible new subscribers. The price shown in the app before purchase is the price that applies to you, including any local currency or tax treatment.
Payment is charged to your Apple ID account when you confirm the purchase. Unless you cancel at least 24 hours before the end of the current billing period, a subscription auto-renews and Apple charges the next period. You can manage or cancel a subscription in your App Store account settings. Any unused part of a free trial may be lost when you purchase a subscription.
Together is included in Taqvo Pro. Features may be altered, paused, or withdrawn; we will not remove a feature you have already paid for within the current billing period without a refund of the unused part.
We may add, change, or remove other features, and we may stop offering Taqvo entirely — if we do, we will give reasonable notice so you can export your data.
8. Maintenance and support
We are solely responsible for providing any maintenance and support for Taqvo. Apple has no obligation whatsoever to furnish any maintenance or support services for it. Reach us at support@taqvo.app or on our support page.
9. Warranty
Taqvo is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that it will be uninterrupted, error-free, or accurate.
We are solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. In the event of any failure of Taqvo to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to Taqvo, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to a warranty will be the developer's sole responsibility.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here removes rights you have as a consumer that cannot be waived.
10. Limitation of liability
To the maximum extent permitted by law, the developer will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, lost data, or loss arising from your use of or inability to use Taqvo — including any injury, loss, or harm suffered during a workout, any failure of Beacon to convey your location, and any reliance on the app as a safety measure.
To the extent liability cannot be excluded, it is limited to the greater of the amount you paid for Taqvo in the twelve months before the claim, or ten US dollars.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
11. Product and intellectual property claims
The developer, not Apple, is responsible for addressing any claims by you or a third party relating to Taqvo or your possession and use of it, including: (i) product liability claims; (ii) any claim that Taqvo fails to conform to an applicable legal or regulatory requirement; (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with Taqvo's use of HealthKit; and (iv) claims under health or fitness-related regulations.
If a third party claims that Taqvo or your possession and use of it infringes their intellectual property rights, the developer, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of that claim.
12. Third-party services and terms
Taqvo works alongside services provided by others — Apple, Google, Spotify, and our hosting and diagnostics providers. You must comply with any applicable third-party terms when using Taqvo. Those services are outside our control, are used at your own risk, and we are not responsible for their content or availability.
13. Legal compliance and export
You represent and warrant that you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties. You will use Taqvo only as permitted by applicable law, including export and re-export control laws.
14. US Government end users
Taqvo and its documentation are "Commercial Items" as defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation" as used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202. They are licensed to US Government end users only as Commercial Items and with only those rights granted to all other end users under these terms.
15. Apple as third-party beneficiary
You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and that upon your acceptance of them Apple will have the right — and is deemed to have accepted the right — to enforce these terms against you as a third-party beneficiary.
16. Governing law
These terms are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-law rules, and the courts of the Philippines will have jurisdiction — except that if you are a consumer resident in the European Union, the United Kingdom, Switzerland, Norway, or Iceland, the law and courts of your country of residence apply, and nothing here deprives you of the protection of mandatory consumer law where you live.
17. Changes to these terms
We may update these terms. The date at the top shows the current version, and we will tell you in the app about changes that matter. Continuing to use Taqvo after a change means you accept the updated terms.
